About ParrotGuard

ParrotGuard provides AI-powered behavior analysis systems for pet parrots, including hardware devices, mobile applications, and cloud services designed to help parrot owners understand and improve their birds' well-being.

User Accounts and Registration

Account Creation

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account
• One account per person; multiple accounts are not permitted

Account Security

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• Use strong passwords and enable two-factor authentication when available

Device and Service Usage

Permitted Use

• Use ParrotGuard devices and services solely for monitoring your own parrots
• Follow all setup and usage instructions provided in user manuals
• Comply with all applicable laws and regulations
• Respect the privacy of others (do not record areas where privacy is expected)

Prohibited Activities

You agree not to:

• Use the Services for any illegal or unauthorized purpose
• Attempt to reverse engineer, hack, or circumvent security measures
• Share your account credentials with others
• Upload or transmit malicious code or harmful content
• Interfere with the proper functioning of the Services
• Use the Services to monitor animals you do not own without explicit permission
• Resell or redistribute the Services without authorization

Data and Privacy

Your Data

Subscription and Payment Terms

Subscription Plans

• Some features require paid subscriptions with recurring billing
• Subscription fees are charged in advance on a monthly or annual basis
• Prices are subject to change with 30 days' notice to existing subscribers
• Free trial periods may be offered for new subscribers

Payment and Billing

• You authorize us to charge the payment method associated with your account
• Subscriptions automatically renew unless canceled before the renewal date
• Refunds are provided according to our refund policy
• Failed payments may result in service suspension

Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods unless required by law

Hardware and Warranty

Device Warranty

ParrotGuard devices come with a limited one-year warranty covering manufacturing defects. This warranty does not cover:

• Damage from misuse, accidents, or normal wear and tear
• Water damage or exposure to extreme conditions
• Modifications or repairs by unauthorized parties
• Software issues resolved through updates

Returns and Exchanges

• 30-day return period for unused devices in original packaging
• Return shipping costs are the customer's responsibility unless the device is defective
• Refunds processed within 5-10 business days of receiving returned items

Intellectual Property

Our Rights

ParrotGuard and its licensors own all rights, title, and interest in the Services, including:

• Software, algorithms, and AI models
• Trademarks, logos, and brand elements
• Documentation and user interfaces
• Aggregated and anonymized data insights

Your License

We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability and fitness for a particular purpose
• Accuracy or completeness of behavioral analysis
• Uninterrupted or error-free operation
• Compatibility with all devices or systems

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for harm to your parrot based on our analysis or recommendations
• You assume full responsibility for decisions regarding your parrot's care

Indemnification

You agree to defend, indemnify, and hold harmless ParrotGuard and its employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

Arbitration and Dispute Resolution

Binding Arbitration

Any dispute arising from these Terms or your use of the Services will be resolved through binding arbitration rather than in court, except for:

• Claims in small claims court
• Intellectual property disputes
• Requests for injunctive relief

Class Action Waiver

You waive your right to participate in class action lawsuits or class-wide arbitration against ParrotGuard.

Termination

Termination by You

You may terminate your account at any time by contacting customer support or through your account settings.

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or harmful activities
• Fail to pay subscription fees
• Create security risks for other users

Effect of Termination

• Your access to the Services will cease immediately
• Data may be retained according to our Privacy Policy and legal requirements
• Provisions regarding intellectual property and limitation of liability survive termination

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through:

Continued use of the Services after changes constitutes acceptance of the new Terms.

Governing Law
